輸入版CDの規制強化から学ぶもの（６）－では具体的に何をすればいいのか

本日は、前回の拙文で書いた内容をさらに掘り下げて、具体的に何をすればいいのかについて、私の考えを書かせていただきます。前回の拙文では、一番大事なことは民意を高めることであると述べ、具体的なテクニック的に必要なことは運用段階の詳細を確認することと、訴訟を利用することを挙げました。ただ、訴訟を起こすことは過激すぎると思う人がみなさんの大部分だと思いますので、本日は、このテクニックのうちの前者について詳細に書かせていただきます。

著作権法の運用方法

著作権の運用段階の詳細は、著作権法体系では、①著作権法、②著作権法施行令、③著作権法施行規則の順に詳細が規定され、この詳細規定に従って運用されます。今回の著作権法改正のうち、輸入版CDの規制強化に関連するものは、著作権法第113条に挿入された新しい項（新5項）になります。そこで、以前から存在する著作権法第113条関係の詳細規定が著作権法施行令と著作権法施行規則に存在するかを見てみると、残念ながらありません。要するに、著作権等への侵害とみなす行為を記述している第113条については、いあままで詳細の規定を明文化して定めずに、文化庁が法律に基づいた行政判断によって諸問題に対応してきていたのだと思います。この場合、新5項のためだけに、施行令や施行規則に詳細規定（要するに、新5項の解釈として、欧米からの輸入版CDについては適用しないというような詳細解釈を追加するということです。）を改正するのは、今までの政府の抵抗状況から考えて現実的に難しいと思います。

施行令と施行規則は、前回の拙文でも書いたように、国民に公表されている資料ですが、これを改正することは難しいということですから、今度は省庁の内部資料である訓令や通達について考えてみたいと思います。訓令や通達は省庁によっては、公開されています。例えば、国税庁では国税に関する膨大な通達が公開されており、これを読まないと本当の税金の運用はできないとまで言われていますし、総務省では電波法関係審査基準（これは訓令になります。）が公開されているだけでなく、これの改正についてもパブリックコメントの収集を行っています。この例から考えれば、著作権法に関する訓令や通達をまずは公開して欲しい、その上で、これらを改正するときはパブリックコメントを収集すべきだという主張を文化庁にすることは、筋の通ったことであり、かつ今後の政策決定過程にも建設的な意見だと思います。ただし、施行令や施行規則と同様に、今までの政府の抵抗状況から考えて、これら著作権法に関する訓令や通達（これらは、絶対にありますよ。情報公開請求してみたら絶対出てくるはずですから。）自体に詳細規定を入れろと要求するのは、残念ながら現実的に難しいと思います。

この辺でとても細かい話になって、読者の皆さんもうんざりしてきている気がしますから、他の運用段階での対応については、簡潔に書かせていただきます。国会審議における議論でもあったように、輸入版CDを実際にチェックするのは税関になります。成田空港とかの国際空港に行けばわかると思いますが、税関は財務省が所管しています。要するに、税関の運用については、財務省が上述の施行規則なり通達なりで規定しているわけですから、ここの部分で詳細規定を検討するということも考えられます。また、言い忘れましたが、実は国会答弁自体が上述の施行規則に類似した影響力を持っていることも一般的に言うことができます。そういう意味で、国会答弁に反した運用を省庁がすれば、これに対しては自信を持って我々は抗議することができるということになります。

こう考えていると、調査するにしても実行するにしてもやらねばならぬことは非常に多くありますね。私が大学にいた頃は、こういうことを学生と夜遅くまで議論していたのを思い出しますが、明日からは参議院選挙の選挙運動期間が始まり、このblogも投票日まで更新できなくなります。この機会を利用して、この輸入版CDの規制強化問題や国民年金問題などで露呈した政治・政策システムの問題について、じっくり考えてみたいと思っています。そのため、この輸入版CDの規制強化問題に関する拙文は6回に渡りましたが、本日でひとまず区切りとさせていただきます。このテーマでのをお読みになったみなさま、コメント等をくださった方どうもありがとうございました。
